    The hemp industry has been eagerly anticipating the release of the US Food and Drug Administration\’s Cannabidiol Enforcement Policy Draft Guidance. The FDA sent the draft of this policy to the White House Office of Management and Budget in July 2020. Out of all of the FDA documents under review at the Office of Management and Budget, the policy on CBD had been pending the longest.

    One common theme that the FDA has focused on on a continuous basis, from its May hearing in 2019 regarding CBD, to the conference in November 2020 on sex and gender specific guidelines, the FDA has commented that it needs more data on CBD product safety. The industry is optimistic that the FDA\’s next sample report, expected this year, will show that key CBD products sold in retail chain stores are being labeled accurately, and that the results from the last report to Congress were atypical of the industry. This was because the FDA only tested products which were sold online, and made claims regarding disease.

    The CBD reinforcement policy was released, and was reviewed by Congress. They found that hemp derived CBD was permitted as a dietary supplement and ingredient for other CBD products.
