    As someone mentioned in this forum, cannabis became legalized in the state of New Jersey, on Monday, February 22nd. There had been a failed legislative attempt and an amendment to the state constitution prior to this legalization. Governor Phil Murphy legalized cannabis last Monday, and signed three bills into law. These bills decriminalize the use of cannabis and also put into place the sale and taxation of recreational cannabis in adults over age 21 years.

    An obvious first question would be whether or not it is legal to smoke cannabis in New Jersey without getting arrested. The answer is yes, and according to one of the three new laws, the amount of cannabis which can be possessed legally is up to six ounces. This amount is completely decriminalized, and in most private places, such as in the home, smoking cannabis is allowed. However, wherever alcohol is prohibited, such as in public places and in transit, consuming cannabis is also not permitted. The legal purchase of cannabis is also still not permitted.

    As far as when cannabis can legally be purchased, Governor Murphy said in six months, yet experts say that it could take more than one year. Existing medical cannabis dispensaries get the first priority at recreational sales. However, cannabis operators first must prove that they have enough of a cannabis supply for medical patients before they can sell it to everyone else. A scarcity of the cannabis supply is an overall concern for the industry.

    It is also illegal to grow cannabis in New Jersey. Unlike other states that have legalized cannabis, there is no provision under the new law that allows for the cannabis plants to be grown at home.
